A MORAY MAN was five times over the legal drink drive limit when he was spotted driving in Portknockie High Street earlier this year.

Jody Smith, 38, already had two previous drink drive convictions when he appeared at Elgin Sheriff Court this week. His latest offence on May 24 was discovered when a member of the public approached him as he revved his car in the coastal town.

The witness could smell alcohol on his breath and police later tracked him down to his Cullen home where he admitted driving while drunk. Smith, who had earlier been attending a party, said that he was “thoroughly ashamed” of his actions that came after he had a disagreement with his wife.

His defence agent told the court that his client understood he would be “extremely fortunate” to escape a custodial sentence.

Sheriff Peter Grant-Hutchison decided to show mercy on father-of-two Smith, fining him £600, disqualifying him from driving for four years and ordering him to complete 200 hours of community service.
