Lengthy ban for Elgin motorist who ‘swigged rum’ while driving

A MORAY MAN has been banned from driving for 45 months after crashing his car in Elgin on a night out drinking with friends.

Elgin Sheriff Court heard that Shaun De-Bruin, 29, had been “swigging rum” in the lead up to his car careering through an Elgin roundabout before ending up crashing into a garden wall on Wittet Drive shortly after midnight on July 15 last year.

De-Bruin heard his actions being described as “sheer stupidity” by Sheriff Olga Pasportnikov after Fiscal Robert Weir told the court that a passenger had described the accused as ‘taking a swig of rum’ while driving the vehicle.

Mr Weir added that De-Bruin then proceeded to drive too fast – over the top of the painted roundabout on Wittet Drive, missing a right-hand bend and losing control of his vehicle. De-Bruin then refused to provide a breath test at the scene.

He pled guilty to driving without due care and attention and at excessive speed while unfit through drink or drugs, and of failing to provide a breath sample.

Sheriff Pasportnikov said: “He was actively drinking while behind the wheel – it is sheer stupidity.”

She sentenced De-Bruin, whose address was given as Doocot Road, to a driving ban of 45 months, to be placed under supervision for 12 months and ordered to undertake 300 hours of unpaid work.
